Welcome to AutopsyAI, a product of Locarda LLC ("Locarda," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of AutopsyAI ("the Service"). By using the Service, you agree to comply with and be bound by these Terms.
1.1 Service: The AutopsyAI application and related services provided by Locarda LLC.
1.2 User: The individual or organization accessing and using the Service.
1.3 Content: All text, data, images, voice recordings, or other materials processed by the Service.
1.4 Protected Health Information (PHI): Any health-related data subject to privacy laws such as HIPAA.
2.1 Permitted Use: AutopsyAI is intended solely to assist in transcription and documentation of autopsy findings. It is not intended for medical diagnosis, treatment, or legal decision-making. Users must rely on their own professional judgment when interpreting or using outputs from the Service.
2.2 Medical Disclaimer: AutopsyAI does not provide medical advice or diagnostic results. It serves as a documentation aid only. Users must verify the accuracy of all generated transcriptions and reports.
2.3 Prohibited Use: You may not:
AutopsyAI is designed and maintained to comply with the Health Insurance Portability and Accountability Act (HIPAA). Locarda uses a HIPAA-compliant cloud infrastructure, maintains Business Associate Agreements (BAAs) with all relevant vendors, and implements controls aligned with industry security standards.
All voice recordings created through the Service are stored locally on the user's device and are never transmitted to Locarda servers.
All transcriptions, case files, and related data are stored in a HIPAA-compliant, SOC 2-ready cloud environment using modern encryption standards (TLS 1.2+ for data in transit and SSE-S3 for data at rest).

Users may delete individual cases at any time within the application. When a case is deleted, all related data is permanently removed from both cloud storage and local device storage. Users may also delete their entire account or request full data deletion by contacting founders@locarda.com. Account deletion results in the removal of all associated data in accordance with privacy and data-retention requirements.
4.1 Ownership: AutopsyAI and all related software, algorithms, and intellectual property are owned by Locarda LLC.
4.2 User Content Ownership: Users retain full ownership of all Content uploaded or processed through the Service. Locarda does not claim ownership over any User Content.
4.3 License: Locarda grants you a limited, non-exclusive, non-transferable license to use AutopsyAI under these Terms.
4.4 Feedback: Any suggestions or feedback you provide may be used by Locarda without obligation or compensation.
5.1 Subscription Plans: AutopsyAI is offered on a monthly or yearly subscription basis. Details of current pricing and features are available within the platform or on autopsy-ai.com.
5.2 Billing: By subscribing, you authorize Locarda to charge your chosen payment method on a recurring monthly basis.
5.3 Cancellation Policy: Users may cancel their subscription at any time. Upon cancellation, users will retain access to the Service for the remainder of their current paid period. Once that period ends, access will be discontinued, and no further charges will apply.
5.3.1 Account Deletion During Billing Cycle: If a user deletes their account during an active billing cycle, no refunds—whether full, partial, or prorated—will be issued for the remaining time in that billing cycle. Access to the Service will terminate upon account deletion, and all associated data will be removed in accordance with our data deletion policies.
5.4 Refund Policy: Refunds are only issued at Locarda's discretion for cancellations made within 14 days of the start of a subscription period.
5.5 Price Changes: Locarda may modify subscription fees with 30 days' notice. Continued use after the notice period constitutes acceptance of the updated pricing.
6.1 No Warranty: The Service is provided "as is," without warranties of any kind, including but not limited to accuracy, reliability, or suitability for legal or medical purposes.
6.2 Liability Cap: To the extent permitted by law, Locarda's total liability shall not exceed the subscription fees paid in the six months preceding the claim. This limitation does not apply to cases of gross negligence, willful misconduct, or violations of privacy laws.
6.2.1 Annual Subscriptions - Liability Calculation: For users on an annual subscription plan, the liability cap described in Section 6.2 shall be calculated based on the prorated equivalent of six months of subscription fees under the annual rate. This ensures the liability cap remains consistent regardless of whether the user is on a monthly or annual billing cycle.
7.1 Verification: Users are responsible for reviewing and confirming the accuracy, completeness, and appropriateness of all transcriptions and reports generated through AutopsyAI. Users are also responsible for deleting case information when required, in accordance with their organizational policies and applicable laws.
7.2 Compliance: Users must comply with all applicable laws and privacy regulations in their jurisdiction.
7.3 Data Export: Users are responsible for exporting and storing any required reports. Locarda does not automatically manage or store user files beyond necessary operations.
8.1 Termination by User: You may stop using the Service or cancel your subscription at any time.
8.2 Termination by Locarda: We may suspend or terminate access for violations of these Terms or misuse of the Service.
9.1 Governing Law: These Terms are governed by the laws of the State of Ohio, United States.
9.2 Arbitration: Any dispute arising under these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its expedited rules, held in Ohio. Each party will bear its own costs unless otherwise required by law.

If a breach involving your personal information occurs, Locarda will notify affected users within 72 hours of receiving notice from our third-party vendors or service providers, as required under applicable law. Notifications will include available details, remediation steps, and recommended user actions.
Locarda shall not be liable for any failure or delay in performing its obligations under these Terms that results from causes beyond its reasonable control, including but not limited to natural disasters, cyberattacks, outages, or government restrictions. During the period of such events, obligations will be suspended for the duration of the force majeure event.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
You may not assign or transfer these Terms or your rights under them without our prior written consent. Locarda may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
These Terms constitute the entire agreement between you and Locarda regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals (whether oral or written).
Locarda may update these Terms periodically. Updates will be communicated via email or in-app notice and will take effect upon posting. Continued use of AutopsyAI after updates constitutes acceptance of the revised Terms.
